BETA TESTER AGREEMENT

This Beta Tester Agreement (this "Agreement") is between MatchFlow (operated by Zack Ballantine) ("MatchFlow," "we") and the individual or club accepting it ("Tester," "you"). By clicking "I agree" or accessing the beta, you accept this Agreement.

1. The Beta

We are granting you early, free access to the MatchFlow platform (the "Beta Service") to evaluate it and give us feedback. The Beta Service is a pre-release evaluation version: features may be incomplete, may change or disappear without notice, and access may be suspended or ended at any time. Beta access is personal to you (or, for a club, to your authorized staff) and may not be shared, resold, or transferred.

2. Confidential Evaluation

The Beta Service is made available to you in confidence, for evaluation purposes. Until we make the relevant features generally available to the public, you agree not to: (a) publicly describe, review, screenshot, or demonstrate nonpublic features of the Beta Service; (b) share access credentials or invite links; or (c) disclose nonpublic information about the Beta Service's features, performance, or roadmap to any third party. You may discuss the Beta Service with other authorized testers and with us. Nothing restricts you from discussing your own club's ordinary operations.

3. Protection of the Service

You will not, and will not permit anyone to: (a) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, models, or methods of the Beta Service; (b) probe, scan, or test the vulnerability of the Beta Service except as we authorize in writing; (c) use robots, scrapers, or other automated means to access or extract data; (d) systematically record outputs to build a competing product or to benchmark for publication; or (e) access the Beta Service to build a competitive product or service.

4. Feedback

We want your ideas and bug reports. You grant MatchFlow a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and commercialize any feedback, suggestions, or ideas you provide, without compensation or attribution obligations. Feedback is not your confidential information.

5. Your Data

Our Privacy Policy applies to personal information processed in the beta. Club testers are responsible for having the right to enter their members' information into the Beta Service and for their own notices to members. We may collect usage analytics and error data to improve the service. Beta data may be deleted or reset; keep independent records of anything you need.

6. Communications Consent

By providing your mobile number and enabling SMS features, you consent to receive service messages (booking confirmations, match invitations, reminders) by SMS. Message frequency varies; message and data rates may apply; reply STOP to opt out of recruitment/optional messages and HELP for help. See the SMS terms in our Terms of Service.

7. AS-IS; No Reliance

THE BETA SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. AI-generated outputs (including match pairings, messages, and summaries) may contain errors; you are responsible for reviewing information before relying on it. Do not use the Beta Service as your sole system of record during the beta.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MATCHFLOW'S TOTAL LIABILITY ARISING OUT OF THE BETA SERVICE WILL NOT EXCEED US$100, AND MATCHFLOW WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR GOODWILL. Nothing limits liability that cannot be limited by law.

9. Term; Termination

This Agreement runs until the beta ends, you stop using the Beta Service, or either party terminates it at any time on notice. Sections 2–4 and 7–10 survive. Section 2 (confidentiality) expires, feature by feature, when we make the relevant feature generally available.

10. General

Governing law: California; venue: Riverside County, California (matching the Terms of Service's arbitration venue). This Agreement plus the Privacy Policy is the entire agreement for the beta; if you later use the general-availability service, the Terms of Service will govern. We may update this Agreement for the beta on notice; continued use is acceptance.
